Proposal Terms & Conditions

The Details

Project Timeline & Payments 

Your proposal is valid for 30 days from the date shown. Our payment structure is simple: 1/2 deposit to kick off your project and the remaining balance is due at launch. Once the final payment is received, we'll launch your website and/or deliver your final files.

Working Together 

We will work together to keep your project on track by providing clear deadlines for content submissions, design reviews and build dates. Since we work closely with you during those build dates, please plan to be available for any questions that come up. Content and design approvals need to arrive by their set deadlines–if they don't, it may push back your launch date.

If your project remains incomplete after 90 days due to pending information from you, we'll need to process your final payment. Don't worry though–once you provide the needed information, we'll complete your project right away.

Website Hosting & Maintenance 

We handle hosting and maintenance payments via monthly credit card charges, starting on your launch date. If you prefer, you can pay quarterly or yearly by check or bank transfer. Please note that all hosting & maintenance payments are non-refundable.

Content Rights & Responsibilities

You confirm that you own the rights to all content provided to us (including photos and copy) and that it doesn't infringe on anyone else's copyright. If any content is found to infringe on others' rights, we can't be held liable for any resulting claims or damages.

Portfolio Rights 

We'd love to showcase our work for you in our portfolio, and note that we are the designer in your footer. If you'd prefer we didn't, just let us know.

Legal Protection

Limitation of Liability:  Neither party will be liable to the other for special, indirect or consequential damages incurred or suffered by the other arising as a result of or related to the Project specified in this document/proposal, and all future projects, whether in contract, tort or otherwise, even if the other has been advised of the possibility of such loss or damages. As it relates to the design and building of a website, this shall include holding harmless Crearé Web Solutions, its employees, agents and/or subcontractors for any claims, damages, loss of business or any type of claim resulting from any malfunction, use, or misuse of the web site, or any errors or omissions that may impact the client’s business or web site in any way.

Indemnification of Host/Designer: The Client will indemnify and hold Crearé Web Solutions, its employees, agents and/or subcontractors harmless against any claims incurred by Crearé Web Solutions arising out of or in conjunction with the Client’s breach of this Proposal, as well as all reasonable costs, expenses and attorneys’ fees incurred therein. The total liability of Crearé Web Solutions under this Proposal, with respect to the Project, regardless of cause or theory of recovery, will not exceed the total amount of fees paid by Client to Crearé Web Solutions during the 6 month period prior to the date the claim arises.

Your website will be built with SEO and accessibility in mind, following standard practices including:

Search Engine Optimization (SEO)

  • Proper use of meta titles and descriptions for all pages to improve search engine rankings.
  • SEO-friendly URL structures for better indexing and readability.
  • Schema markup where applicable (e.g., product listings, artwork details, reviews).
  • Optimized heading structure (H1-H6) to improve content hierarchy and readability.
  • Image optimization using descriptive alt text and compressed file sizes for faster load times.
  • XML sitemaps and proper robots.txt configuration to guide search engine crawlers.
  • User journey tracking with on-site AnalyticsWP (uses 1st party cookie)
  • Integration with Google Search Console for performance insights.

Performance Optimization

  • Lazy loading of images and assets to enhance page speed.
  • Efficient caching strategies via browser caching and server-side optimizations.
  • Mobile-first design approach to ensure fast performance on all devices.

Accessibility Compliance (WCAG Standards)

  • Alt text for all images to ensure screen readers can interpret visual content.
  • Keyboard navigability for improved usability, especially for users with disabilities.
  • Proper color contrast ratios to enhance readability for visually impaired users.
  • ARIA attributes where necessary to provide better accessibility support.
  • Descriptive CTAs instead of vague phrases like “Click here.”
  • Ensuring forms and interactive elements are accessible for all users.

General Best Practices

  • Responsive Design: Ensuring  an optimal experience across desktops, tablets, and mobile devices.
  • Browser Compatibility: Ensuring proper functionality on Chrome, Firefox, Safari, and Edge across Mac, PC, and iOS devices. While efforts are made to support other browsers, full compatibility cannot be guaranteed.
  • Use of secure coding practices to protect user data and prevent vulnerabilities.
  • Compliance with GDPR and privacy regulations where applicable.
  • Form submissions will link to the free version of FluentCRM. There you can collect and email leads. Drip campaigns are available on the paid version which you can upgrade to at any time.
  • Stock Imagery: We have subscriptions to Unsplash & Vecteezy you can use to select images.
  • Training: We’ll teach you how to update your website.
